In the agricultural industry, employers with at least six regular employees or 12 seasonal workers employed more than 30 days per season or 45 days annually must provide workers\u2019 comp coverage.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>What does the workers\u2019 compensation law cover?<\/em><\/h3>\n\n\n\n<p>As per the Florida workers\u2019 compensation <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0400-0499\/0440\/0440.html\" target=\"_blank\" rel=\"noreferrer noopener\">statutes<\/a>, the state legislature intends that the law be interpreted \u201cso as to assure the quick and efficient delivery of disability and medical benefits to an injured worker,\u201d as well as facilitating the worker\u2019s return to gainful reemployment at a \u201creasonable cost\u201d to their employer.<\/p>\n\n\n\n<p>In return for having your employer\u2019s insurer pay your medical expenses and a certain amount of your lost wages, you cannot usually file a personal injury lawsuit. This is the no-fault aspect of the workers\u2019 compensation system. However, if a third party is liable for your injuries due to negligence or recklessness, you may file a personal injury lawsuit against that person or entity. If the employee is physically capable of engaging in sedentary work, they are not eligible for this compensation.<\/li>\n\n\n\n<li><strong>Temporary Total Disability\u2013<\/strong> Following a <a href=\"https:\/\/www.kogan-disalvo.com\/tampa-catastrophic-injury-lawyer\/\" target=\"_blank\" rel=\"noreferrer noopener\">serious injury<\/a>, a worker may receive up to 80% of their regular wages for up to six months. They do not receive benefits for the initial seven days of the disability unless the condition persists for more than 21 days.<\/li>\n\n\n\n<li><strong>Temporary Partial Disability\u2013<\/strong> If an employee can return to work but is not able to perform their normal job duties and cannot earn at least 80% of their pre-accident wages, they may receive TPD benefits for up to 104 weeks.<\/li>\n\n\n\n<li><strong>Impairment\u2013 <\/strong>When a patient reaches Maximum Medical Improvement (MMI), their doctor has determined they will not get any better. A worker reaching MMI with work limitations may prove eligible for impairment benefits. To receive such benefits, workers are given an impairment rating. This rating determines the benefit they receive.<\/li>\n<\/ul>\n\n\n\n<p>The weekly compensation rate in Florida is 100% of the statewide average weekly wage. That average weekly wage is determined by the Department of Economic Opportunity. These death benefits include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Funeral expenses up to $7,500.<\/li>\n\n\n\n<li>Payments to a surviving spouse without children of 50% of the late worker\u2019s salary.<\/li>\n\n\n\n<li>Payments to a surviving spouse with children of 50% of the salary plus 16.67% of the weekly salary per child or dependent.<\/li>\n\n\n\n<li>If no surviving spouse, payment to children or dependents of 33.3% of the late worker\u2019s wages per child, up to age 18. It is not unusual for employers or their insurance companies to attempt to prevent workers from receiving the benefits to which they are entitled. Thousands of injured Floridians find their workers\u2019 comp claims denied each year.<\/p>\n\n\n\n<p>One common rejection ploy is alleging the injury was a pre-existing condition and not related to the work environment. Another is alleging that the accident did not occur while at work. The insurer may also believe the injury is less serious than claimed.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>What type of injuries are ineligible for workers\u2019 comp coverage?<\/em><\/h3>\n\n\n\n<p>Workers\u2019 comp does not cover employees injured while under the influence of alcohol or drugs, those injured in an altercation with another person, or any self-inflicted injuries.&nbsp; As noted, failing to notify your employer of your injury within 30 days is also grounds for denial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Appealing a workers\u2019 comp denial<\/em><\/h3>\n\n\n\n<p>If your <a href=\"https:\/\/www.kogan-disalvo.com\/tampa-workers-compensation-lawyer\/denials\/\" target=\"_blank\" rel=\"noreferrer noopener\">work injury claim is denied<\/a>, contact a Tampa workers\u2019 compensation lawyer right away. If no agreement is reached, the next step is a workers\u2019 comp hearing with the OJCC.<\/p>\n\n\n\n<p>This hearing involves a judge, not a jury. It must take place within 90 days of the mediation failure but is also limited to 210 days from the Petition for Benefits filing. After a pre-trial hearing, a trial is scheduled for both sides to present their case, call witnesses, and submit evidence.&nbsp; The judge makes a decision within 30 days.<\/p>\n\n\n\n<p>If either side does not agree with the judge\u2019s decision, there is one final appeal. Within 30 days of the judge\u2019s decision, that side must file an appeal with the First District Court of Appeal.
