The helmet laws may seem complicated, but they are straightforward when you understand them correctly. Eye protection and headset laws are simpler.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Helmet Requirements<\/h3>\n\n\n\n<p>Do you have to\u00a0<a href=\"https:\/\/ridesmartflorida.com\/motorcycle-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">wear a helmet<\/a>\u00a0on a motorcycle in Florida? This seems like a complicated answer, but yes and no. If the rider is over 21 and has insurance coverage with a minimum of $10,000 for medical benefits if involved in an accident, you do not have to wear a helmet on a motorcycle in Florida.\u00a0<\/p>\n\n\n\n<p>However, if you are under 21, you must wear a helmet while riding or operating a motorcycle at all times.&nbsp;<\/p>\n\n\n\n<p>Florida helmet laws are thoroughly discussed in statute\u00a0316.211(3b). At <a href=\"https:\/\/www.kogan-disalvo.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kogan &amp; DiSalvo Personal Injury Lawyers<\/a>, we always recommend wearing a helmet whether the law permits it or not because you are less likely to sustain serious head trauma in a motorcycle accident.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Eye Protection<\/h3>\n\n\n\n<p>Florida statute\u00a0316.211(2)\u00a0requires you to always wear eye protection while operating a motorcycle. The Department of Transportation must approve the eye protection.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Headset Laws<\/h3>\n\n\n\n<p>You cannot wear a headset, headphones, or other form of listening device while operating a motorcycle in Florida. Statute\u00a0316.304(1)\u00a0states that hearing aids or other hearing-assisted devices can be worn.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Licensing and Endorsements<\/h2>\n\n\n\n<p>Florida has licensing and endorsement requirements for operating motorcycles on the roadways. You must have an endorsement on your license or obtain a \u201cmotorcycle only\u201d license. You can get the endorsement by taking an\u00a0approved motorcycle safety course.\u00a0<\/p>\n\n\n\n<p>These courses teach you a great deal about riding safely on the roadways. They also cover strategies and techniques for avoiding collisions and managing your environment. You will also get to practice the strategies and techniques you learned in a safe environment.&nbsp;<\/p>\n\n\n\n<p>Here are the steps to obtaining your motorcycle endorsement. You must have at least a valid Class E driver&#8217;s license. Complete an approved motorcycle safety course by an authorized provider. After passing the course, you have one year to get your motorcycle endorsement, or it will be deemed invalid, and you will have to retake the course.&nbsp;<\/p>\n\n\n\n<p>After completing the course, you can go to a driver\u2019s license office and notify them that you completed and passed the course. Pay the endorsement fee, and you will get a new license with your motorcycle endorsement.<\/p>\n\n\n\n<p>A proper motorcycle safety course will teach you everything you need to know about driving a motorcycle safely.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Motorcycle Equipment Regulations<\/h2>\n\n\n\n<p>Many laws and regulations in Florida concern motorcycles&#8217; having the correct equipment to be roadworthy. For example, Statute\u00a0316.261(3)\u00a0states that all wheels must have brakes, so a motorcycle&#8217;s front and back wheels must have working brakes. A motorcycle exhaust system must not be modified\u00a0to be louder\u00a0and must prevent excessive\u00a0smoke or fumes.\u00a0<\/p>\n\n\n\n<p>A\u00a0motorcycle&#8217;s handlebars\u00a0must not be taller than the operator&#8217;s shoulders. According to Florida Statute\u00a0316.271(1), you must have a working horn on a motorcycle.\u00a0Mirrors are required\u00a0on motorcycles in Florida. A motorcycle must have a\u00a0working headlight, and it must be\u00a0on at all times\u00a0while you are operating it.\u00a0<\/p>\n\n\n\n<p>Other Florida motorcycle equipment laws include a\u00a0rear red reflector\u00a0must be visible, a\u00a0stop lamp\u00a0is required,\u00a0turn signals\u00a0are required and a\u00a0tail light\u00a0is required. Your stop lamp and turn signals must also meet the requirements of Florida Statute\u00a0316.234(2).<\/p>\n\n\n\n<div class=\"wp-block-button aligncenter\"><a class=\"wp-block-button__link has-white-color has-text-color has-background\" href=\"tel:5613759500\" style=\"background:linear-gradient(135deg,rgb(206,166,44) 0%,rgb(135,106,2) 91%)\" rel=\"\">No fee unless we win. According to Florida Statute\u00a0316.2085 (1), you must have proper seating for your passenger.\u00a0<\/p>\n\n\n\n<p>You are also required to have\u00a0mandate-specific footrests\u00a0for your passenger. Any passenger under the age of 21 must wear a Department of Transportation-approved helmet.\u00a0<\/p>\n\n\n\n<p>Keeping your passenger comfortable is just as important as keeping yourself comfortable, if not more so. A happy passenger makes a good trip a great one.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Insurance Requirements<\/h2>\n\n\n\n<p>It may sound odd, but Florida law does\u00a0<a href=\"https:\/\/themotoblog.com\/motorcycle-laws-in-florida-2\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">not require motorcyclists<\/a>\u00a0to carry insurance. Paying for motorcycle insurance can cost you a lot less in the long run. Florida has the Financial Responsibility Law, which applies if you cause bodily harm while riding your motorcycle.\u00a0<\/p>\n\n\n\n<p>The Financial Responsibility Law states that if you are found guilty of causing bodily harm to another person while operating your motorcycle, you establish financial responsibility by purchasing liability coverage with a minimum of $10,000 per person per accident and $20,000 per accident total.&nbsp;<\/p>\n\n\n\n<p>Penalties for failing to comply include suspension of your license, reinstatement fees, and more.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Riding in Pairs<\/h2>\n\n\n\n<p>Riding\u00a0motorcycles two wide\u00a0or in pairs in the same lane on the roadways is legal in Florida. However, riding more than two motorcycles wide in the same lane is illegal.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">DUI Consequences<\/h2>\n\n\n\n<p>Florida state laws are quite strict when it comes to drinking and operating a motorcycle. They have what is known as a tiered system based on blood alcohol content (BAC) and how many times you have been caught drinking and driving.&nbsp;<\/p>\n\n\n\n<p>If your BAC is 0.08% or higher, you will get hefty fines and possible jail time. Here are some of the possibilities of the consequences of drinking while operating a motorcycle:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First Offense: BAC 0.08% to 0.14% penalties include a $500 to $1000 fine with a possibility of up to six months jail time.&nbsp;<\/li>\n\n\n\n<li>Second Offense: A BAC of 0.08% to 0.14% can result in fines of $1000 to $2000 and up to nine months in jail time.&nbsp;<\/li>\n\n\n\n<li>First Offense: A BAC of 0.15% or higher carries penalties, including a $1000 to $2000 fine and mandatory ignition lock device installation.<\/li>\n\n\n\n<li>Second Offense: A BAC of 0.15% or higher penalties include a $2000 to $4000 fine and mandatory ignition lock device installation.<\/li>\n<\/ul>\n\n\n\n<p>You can also receive up to one year of probation and a mandatory 50 hours of community service.
