Instead, an Ore tenus motion for a <strong>directed<\/strong> verdict was used, which means a verbal motion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Prima_Facie_Mean_in_Legal_Terms\"><\/span>What Does Prima Facie Mean in Legal Terms?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"1000\" height=\"364\" src=\"https:\/\/www.kogan-disalvo.com\/wp-content\/uploads\/2023\/03\/iStock-489544923-court-order.png\" alt=\"Vignette of a gavel in front of a judge reading from a court order\" class=\"wp-image-6353\"\/><\/figure>\n\n\n\n<p><strong>Prima facie<\/strong> in legal terms means that a person sets up the bare minimum necessary to establish their claim. For example, in a negligence action such as this client\u2019s, the Kogan &amp; DiSalvo lawyer had to prove that there was a duty on the defendant to do something about the uneven staircase. The defendant breached that duty, and as a direct result, the client suffered injuries.<\/p>\n\n\n\n<p>The risks of a court ruling the plaintiff has failed to prove the prima facie case is that the judge takes the case away from the jury.
