The personal representative can be named in one of two ways:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>The decedent\u2019s will:<\/strong> If the deceased individual (the decedent) has a valid will at the time of his or her death, the personal representative should be named in the will.<\/li>\n\n\n\n<li><strong>Through probate:<\/strong> If a decedent dies intestate (i.e., he or she has no valid will in place at the time of death), the probate court will name someone as the personal representative.<\/li>\n<\/ol>\n\n\n\n<p>The personal representative is often a family member. However, there is no legal requirement that the representative has to be related to the deceased.<\/p>\n\n\n\n<p><strong>In a wrongful death lawsuit, the personal representative seeks to recover damages sustained by the estate that the decedent could have claimed had he or she survived.<\/strong> However, the estate is not the only party that may recover damages for wrongful death.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_Is_Entitled_to_Damages_in_a_Wrongful_Death_Claim\"><\/span>Who Is Entitled to Damages in a Wrongful Death Claim?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1000\" height=\"364\" src=\"https:\/\/www.kogan-disalvo.com\/wp-content\/uploads\/2023\/08\/iStock-1396995096-memorial-candles.jpg\" alt=\"Many memorial candles burning on the ground in the night\" class=\"wp-image-8705\"\/><\/figure>\n\n\n\n<p>When filing a wrongful death lawsuit, the personal representative is required to name all of the parties that may benefit from a settlement or award. Surviving family members make up the majority of potential beneficiaries, but other parties may be entitled to compensation as well.<\/p>\n\n\n\n<p>A wrongful death attorney can help you identify all of the parties that should be included in your claim. The following individuals may be entitled to recovery of specific losses related to the death of a loved one:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Spouses:<\/strong> Loss of companionship and protection, pain and suffering damages<\/li>\n\n\n\n<li><strong>Minor children (a child under the age of 25):<\/strong> Loss of parental guidance and protection, pain and suffering damages\n<ul class=\"wp-block-list\">\n<li>Children of any age can recover these damages if the decedent has no living spouse<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Parent(s) of a minor child:<\/strong> Pain and suffering damages\n<ul class=\"wp-block-list\">\n<li>The parent or parents of an adult child can make a similar claim in the absence of other surviving family members (i.e., a spouse, grandchildren, etc.)<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>All survivors:<\/strong> Loss of support and services; those who paid medical bills or funeral expenses may recover additional economic damages<\/li>\n<\/ul>\n\n\n\n<p>The estate may recover compensation for medical and funeral expenses, as well as lost wages from the time the decedent was injured and his or her death (not applicable in cases of sudden death). Florida law also allows the estate to pursue recovery of expected earnings and other foreseeable financial gains (known as \u201c<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0700-0799\/0768\/Sections\/0768.21.html\/\" target=\"_blank\" rel=\"noreferrer noopener\">prospective net accumulations<\/a>\u201d) in select circumstances.
