For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dehydration<\/li>\n\n\n\n<li>Malnutrition<\/li>\n\n\n\n<li>Complications from bedsores<\/li>\n\n\n\n<li>Medication errors<\/li>\n\n\n\n<li>Neglect<\/li>\n\n\n\n<li>Bedsores<\/li>\n\n\n\n<li>Infections<\/li>\n\n\n\n<li>Slip and falls<\/li>\n\n\n\n<li>Unsanitary conditions<\/li>\n\n\n\n<li>Assault and other abuse<\/li>\n<\/ul>\n\n\n\n<p>For many of these issues, the underlying cause is understaffing. Unfortunately, much like prisons and immigrant detention facilities, nursing homes are often owned or operated by corporations that seek a profitable bottom line. As a result, this profit-led approach leads to cutting corners that can be disastrous for the seniors they serve.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Nursing_Home_Wrongful_Death_is_Proven\"><\/span>How Nursing Home Wrongful Death is Proven<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>\u201cWrongful death\u201d is defined by <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.19.html\" target=\"_blank\" rel=\"noreferrer noopener\">Florida Statute \u00a7 768.19<\/a>, which holds that it occurs when a person or entity causes the death of a person by \u201c<strong>wrongful act, negligence, default, or breach of contract or warranty.<\/strong>\u201d&nbsp; This is further defined by Chapter 400 of these same statutes, which addresses personal injuries and deaths that occur in these facilities.<\/p>\n\n\n\n<p>Like most lawsuits, wrongful death in a nursing home must be proven to a \u201c<strong>preponderance of the evidence.<\/strong>\u201d&nbsp; This involves satisfying that the elements of wrongful death were \u201cmore likely than not\u201d to have occurred. These elements include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The nursing home owed a <strong>duty of care<\/strong> to the resident, i.e., ensuring their safety;<\/li>\n\n\n\n<li>The nursing home <strong>breached this duty of care<\/strong> to the resident, i.e., by not providing adequate food, water, or other necessary services;<\/li>\n\n\n\n<li>The <strong>senior in the care of the nursing home died<\/strong>; and<\/li>\n\n\n\n<li>The death of that individual was <strong>directly caused by the nursing home\u2019s breach of duty.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>As the term preponderance of the evidence implies, evidence will be required to prove that these elements are more likely than not satisfied.&nbsp;<\/p>\n\n\n\n<p><strong>Some of the evidence that may help to prove these elements include:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Medical records<\/li>\n\n\n\n<li>Witness statements<\/li>\n\n\n\n<li>Photos of wounds, bedsores, or other conditions<\/li>\n\n\n\n<li>Written accounts or incident reports about the cause of death<\/li>\n\n\n\n<li>Photos and videos of sub-standard conditions in the nursing home<\/li>\n\n\n\n<li>Photos and videos of abuse<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_Liable_for_a_Nursing_Home_Wrongful_Death\"><\/span>Who is Liable for a Nursing Home Wrongful Death<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0400-0499\/0400\/Sections\/0400.023.html\" target=\"_blank\" rel=\"noreferrer noopener\">Chapter 400<\/a> states that a case may be brought against the \u201c<strong>licensee, the licensee\u2019s management or consulting company, the licensee\u2019s managing employees, and any direct caregivers.<\/strong>\u201d&nbsp; This casts a fairly broad net for who may ultimately be liable for the death of a senior in a nursing home.<\/p>\n\n\n\n<p>Those held liable can include the owner, operator, or even employees. In addition to paying compensation, the lawsuit may be able to shut down facilities that mistreat individuals in their care or prevent abusive workers from working in this industry again.<\/p>\n\n\n\n<p>Though global events will affect care in facilities, many nursing homes have not made adequate adjustments for Covid-19. While this raises previously uncontemplated issues, some owners and managers have <strong>failed to make the necessary and available changes<\/strong>. Unfortunately, this has led to many deaths that were preventable with more caution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Potential_Damages_that_are_Available_in_a_Wrongful_Death_Claim\"><\/span>Potential Damages that are Available in a Wrongful Death Claim<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The damages, or money required to cover a plaintiff\u2019s losses, are a bit different in wrongful death than in personal injury cases. Like other tort cases, these can include <strong>\u201ccompensatory\u201d damages<\/strong>&#8211;to compensate the survivors for the economic and non-economic aspects of their loss. However, with retirees, there often is no paycheck that would be lost.<\/p>\n\n\n\n<p>Despite some damages not being applicable, there are still many others suffered by surviving family members that can be addressed in the case. This can include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lost companionship<\/li>\n\n\n\n<li>Medical expense<\/li>\n\n\n\n<li>Funeral expenses<\/li>\n\n\n\n<li>Mental pain and suffering<\/li>\n<\/ul>\n\n\n\n<p>In cases where the actions or behavior of the nursing home and its staff was particularly egregious, <strong>punitive damages<\/strong> may be included. These are not \u201ccompensatory.\u201d They do not compensate a plaintiff for their loss; instead, they punish and make an example of a nursing home that acted <strong>intentionally or with gross negligence<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Moreover, these damages are different from <strong>survival action damages<\/strong>. Survival action lawsuits arise from a cause of action (right to sue) that the senior had when they died&#8211;that are not lost because of their death&#8211;i.e., the right to sue the nursing home for personal injury. This allows the family to collect the damages their loved one would have been able to&#8211;had they survived the accident or incident that caused their death.<\/p>\n\n\n\n<p>Under Chapter 400 of the Florida Statutes, surviving family members will have a <strong>choice of damages from a survival action or wrongful death<\/strong>. Because the issue of determining liability for the actions that caused their death will be the same process in court for either. However, they will need to choose between wrongful death damages and survival action damages.
